Abstract
In the United States (U.S.), export controls are enforced through multiple laws, regulations, and procedures administered by four regulatory agencies. As a result, entities operating in the U.S. market must have a nuanced compliance program and awareness of how export compliance obligations established by each regulator apply to their business practices. Across various U.S. sectors, the creation of voluntary private sector standards has proven successful in fostering industry-wide export control compliance improvements and assisting companies in better adhering to legislative requirements. However, existing standards focus on export controls for non-nuclear industries and do not provide guidance for exports of nuclear materials, equipment, and technology that are subject to specific regulations.
To address the specific needs of the nuclear industry, The Pacific Northwest National Laboratory (PNNL), Margaret Harding of 4 Factor Consulting, along with government and industry representatives, are collaboratively developing a U.S. export control standard under the American Nuclear Society. This standard aims to provide exporters with essential information and requirements for adhering to 10 Code of Federal Regulations (CFR) Part 110 and 810. The standard details the information required for general and specific licenses and authorizations, outlines the reporting obligations before and after export, and provides requirements and guidance for establishing, implementing, and maintaining internal compliance programs. Prior to this effort, there was no industry standard to guide compliance with 10 CFR Part 110 or 810, highlighting the significance of this initiative.
